Terms of Service

Welcome to NameRight ("NameRight", "we", "us", or "our"), an individual-operated digital service providing state-based legal name change guidance. These Terms of Service ("Terms") govern your access to and use of our services available at https://www.nameright.app (the "Service").

By creating an account, purchasing a plan, or otherwise using the Service, you confirm that you: (a) are at least 18 years of age (or, if under 18, you may use the free tier with parental consent); (b) have read, understood, and agree to be bound by these Terms; (c) agree to our Privacy Policy; and (d) are authorized to enter into this agreement on behalf of yourself or any organization you represent.

Important: If you do not agree to these Terms, you may not use the Service. Continued use after any update constitutes acceptance of the revised Terms.

NameRight is a document guidance and preparation platform that helps individuals navigate the legal name and gender marker change process in the United States. We provide:

• State- and county-level filing guidance based on publicly available court records
• Personalized checklists, form preparation tools, and document templates
• Privacy path analysis and readiness scoring
• Policy change alerts and institution update guidance

NameRight is not a law firm and does not provide legal advice. Our tools are informational only. Always verify current requirements with your local court before filing. For legal advice, consult a licensed attorney — many LGBTQ+ legal organizations offer free consultations.

Service nature: The Service is a digital, intangible product. Access is granted immediately upon payment confirmation. Because of the instant-delivery nature of digital services, refunds are subject to the specific limits described in Section 5 and our Refund Policy.

You must be at least 18 years old to create an account and make purchases. If you are under 18, you may use the free tier with parental consent.

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us immediately at support@nameright.app if you suspect unauthorized access.

NameRight offers one-time purchase plans. Payments are processed by Waffo Pancake (Merchant of Record, PCI-DSS compliant) or PayPal. Payment card data is processed exclusively by Waffo Pancake and PayPal and is never stored on our servers. By completing a purchase, you agree to the applicable payment processor's terms.

All prices are in USD. We reserve the right to change pricing at any time; changes will not affect purchases already completed.

Refunds: All purchases are one-time payments. No subscription, no auto-renewal. Refund requests submitted within 7 days are reviewed against account activity. Once you access personalized materials or generate documents, the purchase becomes non-refundable. To request a refund, email support@nameright.app within 7 days of purchase with your order ID. Processing time: 5–7 business days. See our Refund Policy for full details.

If you believe a charge was made in error, please contact us first at support@nameright.app before initiating a dispute with your bank or card issuer. We commit to responding within 2 business days and resolving confirmed billing errors within 5 business days.

If a chargeback is initiated despite our offer of resolution, we may provide the payment processor and bank with the transaction and service-delivery records needed to contest the dispute, which may include proof that access to your plan was granted.

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to reverse-engineer, scrape, or copy our guidance database
• Share account credentials with others
• Submit false information that could mislead other users or our systems
• Use the Service in any way that could harm, disable, or impair it

AI-generated content standards: Where the Service produces or assists with content using artificial intelligence, you must comply with our Acceptable Use Policy (AUP). The AUP prohibits, among other things, generating sexual/NSFW content, violence or gore, hate speech, child-unsafe content (CSAM), deepfakes or impersonation of real people, and content that infringes copyrights or trademarks. It also describes enforcement actions, the user reporting channel, and our content moderation mechanisms.

Output ownership: Subject to these Terms, AI-generated content produced by or for you through the Service ("Output") belongs to you. You may use Output for any lawful purpose permitted under Section 7.

Input license: By submitting content to the Service ("Input"), you grant NameRight a limited, non-exclusive license solely to provide the Service to you. We do not use your Input to train AI models without your explicit consent.

Third-party AI models: Our AI-assisted features are powered by third-party model providers, including OpenAI (GPT-4o-mini) and, as a fallback, Meta Llama 3.1 8B Instruct. Output may be influenced by these providers' models. We do not guarantee specific output quality and are not responsible for content generated by third-party models. See our Acceptable Use Policy for model disclosure details.

Output accuracy: AI-generated content may contain errors or inaccuracies. You are responsible for reviewing and verifying Output before relying on it.

All content on NameRight — including guidance text, tool logic, UI design, and branding — is owned by NameRight and protected by copyright. You may not reproduce or redistribute our content without written permission.

Document templates provided to you as part of your plan are licensed for your personal, non-commercial use in your own name change process.

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Payment card data is processed exclusively by our PCI-DSS compliant payment processor (Waffo Pancake) and is not stored on our servers. Account data is retained after cancellation as described in our Privacy Policy.

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or accuracy of output. We do not warrant that the guidance provided is complete, error-free, or current for every jurisdiction. Court requirements change frequently — always verify with your local court before filing.

AI output disclaimer: AI-generated output may be inaccurate, incomplete, or outdated. Do not use it for legal, medical, financial, or other professional advice. Always verify with qualified professionals before acting on AI content.

To the maximum extent permitted by law, NameRight shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service, including court filing errors, rejected applications, or any outcome of your name change process.

Our total liability for any claim arising from your use of the Service shall not exceed the amount you paid for your plan.

You agree to indemnify NameRight from any claims, damages, or expenses arising from your violation of these Terms or misuse of the Service.

These Terms remain in effect while you use the Service. We may suspend or terminate your account if you seriously violate these Terms, engage in suspected fraud, or as required by law. If we terminate the Service for reasons other than your breach, we will refund proportionally any prepaid, unused portion. You may delete your account at any time from Settings or by contacting support@nameright.app.

Any dispute arising from or relating to your use of NameRight should first be addressed directly with us via support@nameright.app so that we can attempt to resolve it informally.

These Terms and any disputes arising from or relating to the Service will be handled in accordance with applicable law and competent jurisdiction, unless otherwise required by mandatory consumer protection laws. NameRight does not designate any specific U.S. state court as the exclusive venue.

Dispute resolution terms may be updated as NameRight completes entity registration. Any such update will not reduce your existing rights under applicable consumer protection laws.

We may update these Terms from time to time. Material changes will be announced at least 14 days before the effective date by email and by updating this page. Continued use of the Service after changes constitutes acceptance.

If you have any questions about these Terms, billing, refunds, privacy, or security, you may reach us at support@nameright.app. We usually respond to support-related requests within 1–2 business days. Billing, privacy, and data deletion requests are prioritized.
